Ministry of Justice sets out two main strategic directions to make the justice sector in Cambodia effective


Phnom Penh÷ Through the campaign to resolve the congestion of criminal cases in the Capital-Provincial Courts for 1 year and 1 month, which was closed in the past, the Ministry of Justice found that some cases in the courts were congested due to  Out-of-court dispute resolution mechanisms are insufficient, incomplete, and therefore some minor issues have to be pushed to the judiciary.

This is according to Mr. Chin Malin, Secretary of State and Spokesperson of the Ministry of Justice in the press conference of the Spokesperson Unit of the Royal Government on the morning of October 7, 2022 under the theme [Achievements of 5 years.  Ministry of Justice].

Mr. Jean Malin claimed that although the campaign to resolve the congestion of criminal cases in the capital-provincial courts has been completed, but the principles of the measures that have been put in the past, including measures to implement non-prison sentences.  Out-of-court mediation is still being pursued for the sake of justice.

A spokesman for the Ministry of Justice said:  Through this campaign, we find that some cases are congested due to insufficient mediation and out-of-court dispute resolution mechanisms, and all minor issues have hit the courts].

According to Mr. Jean Malin, the congestion in this case is also related to the court’s limited resources and physical infrastructure, so starting from this campaign, the Ministry has organized a reform to create resources, both financial and physical infrastructure to respond.  To the growth of criminal cases that have occurred.

At the same time, Mr. Nak Ser Kirin, Undersecretary of State of the Ministry of Justice, said that the overall results of the congestion criminal case campaign that has been conducted in the capital-provincial courts throughout the country, both the prosecution, the investigation and the trial.  A total of more than 37,900 cases, equivalent to 96% of the criminal case, jammed a total of more than 39,500 cases.

He added that more than 12,600 cases have been tried, accounting for 97% of the total of more than 13,000 cases.  In addition, the Capital-Provincial Courts throughout the country also handled more than 62,800 new criminal cases, equivalent to 78% of the total number of new cases of more than 80,400 cases.

During the campaign period, a number of additional criminal procedures were implemented that could help alleviate overcrowding in prisons, such as: Deciding not to be remanded in custody and not subject to judicial review;  Second: Issuance of Closing Order, Third: Decision to acquit, Fourth: Ordinary sentence, Fifth: Suspension of probation, and Sixth: Release of convicts who have completed their sentences.  Etc.
